Terms and Conditions of Sale and Use for DRIVINE Services

The following terms and conditions of sale are concluded between the company DRIVINE, registered with the RCS of Toulouse under number 918755414, whose registered office is located at 462 Avenue de Fronton, 31200 Toulouse ("DRIVINE"), and any individual or entity, acting as a professional or not, (hereinafter referred to as the "Client") wishing to book a chauffeur-driven passenger transport service or VTC (hereinafter the "Service") for their own account or on behalf of individuals who have duly authorized them to do so (the "Passenger(s)").

By booking a Service with DRIVINE, the Client and the Passengers fully and unreservedly adhere to DRIVINE's general terms and conditions of sale (hereinafter the "Terms of Sale" or "CGV"). Any contrary condition opposed by the Client or the Passenger, including any contrary clause from their own general terms and conditions, is not binding on DRIVINE unless expressly, explicitly, and in writing accepted by DRIVINE.

DRIVINE reserves the right to modify the CGV at any time. The Terms of Sale applicable to the booking of a Service are those in force on the date of the firm booking of the Service (hereinafter "the Booking"), evidenced by the receipt by DRIVINE of the written confirmation of the booking.

DRIVINE guarantees the quality and reliability of the passenger transport services it offers, as well as its professionalism.

 

1. BOOKING

 

DISCLAIMER

To book and/or pay for a Service, the Client must be of legal age or emancipated minor, be legally capable of contracting, and comply with the General Terms of Sale.

The Client is responsible for the bookings they make both on their own behalf and for the Passengers when acting on their behalf. The Client guarantees the truthfulness and accuracy of the information provided.

 

BOOKING REQUEST

 

A booking request for a Service can be made by phone, email, via the website www.drivine.fr, and by any other means approved by DRIVINE. When made by phone, the booking request must necessarily be confirmed in writing, particularly by email or via DRIVINE's website.

The booking request must include the following minimum information:

Dates, times, and itineraries:

  • The date, time, and location of initial pick-up of the Passenger(s)

  • The final drop-off location and any intermediate stops if applicable

  • The number of people to be transported (specify if the passenger has reduced mobility and/or is in a wheelchair)

  • The approximate number, weight, and overall volume of luggage

  • Means of communication:

    • Passenger's phone number

    • Passenger's email

    • Desired vehicle model or category.

For any new Client, the booking will only be confirmed after DRIVINE has verified the payment methods of the Client (see "Payment" section below).

ISSUANCE OF A QUOTE

Upon receipt of the booking request, DRIVINE will provide a quote based on the information provided by the Client or the Passenger.

Any change in the information provided may modify the initial price of the Service (change of vehicle model, capacity, mileage, exceeding duration, etc.). Additionally, any service not included in the quote will be billed in addition to it.

 

CONFIRMATION OF THE RESERVATION

 

In case of acceptance of the quote, the Client must confirm their booking in writing to DRIVINE by means approved by the latter ("Confirmation of the reservation").

Upon receipt of the Confirmation of the reservation, a transport contract is formed between DRIVINE and the Client.

 

2. RATES

 

The Services are offered at the rates indicated in DRIVINE's pricing grid attached to the quote.

The rates are mentioned excluding taxes, and VAT is not applicable in accordance with Article 293 B of the General Tax Code (CGI).

The pricing rules may vary depending on certain circumstances such as public holidays, peak periods, pick-up zone, and/or use of the Service, time of day, etc.

The rates do not include urban toll systems, highway tolls, parking meters, parking fees, entrance fees to sites, public or private properties, or driver meals. These will be charged for any Service order lasting more than three (3) hours.

The price of the Service indicated in the quote issued by DRIVINE may be revised to take into account, in particular, the increase in fuel prices and all expenses incurred for the purposes of providing the Service.

Additional fees may be charged for specific Client requests such as baby seats, special refreshments. The amounts charged will be specified in the quote or the Confirmation of the reservation.

DRIVINE reserves the right to modify the pricing grid at any time without notice. These changes will be communicated to the Client and will apply to all Services booked after the pricing grid update.

EXCEEDING HOURLY OR DISTANCE LIMITS (EXCLUDING TRANSFER SERVICES)

 

For any Service, DRIVINE may decide on a minimum billing specified in the quote.

At any time during a Service, the Client may decide to change the destination or interrupt it. In this case, the Client will be charged for the time and distance traveled and performed, and at least the flat rate provided for in the booking.

Any exceeding of hourly or distance limits compared to those scheduled at the time of booking will be billed in addition to the initial price provided in the quote, according to the rate in effect on the date of the booking.

 

3. PAYMENT

 

METHOD OF PAYMENT

 

The payment for the Services can be made by the following means of payment: cash, bank transfer, credit card.

For professional or regular Clients, DRIVINE reserves the right to invoice its Services by direct debit from the Client's bank account.

In case of non-payment by the Client on the agreed due date, DRIVINE reserves the right to apply late payment penalties at the rate of three times the legal interest rate.

 

DISPUTES

 

In the event of a dispute, the Client may resort free of charge to a consumer mediator by contacting CNPM MÉDIATION CONSOMMATION, either by email at consommation@cnpm-mediation-consommation.eu, or by post at CNPM - MEDIATION CONSOMMATION, 27 Avenue de la Libération, 42400 Saint-Chamond.

 

4. CANCELLATION

 

Any cancellation of a reservation by the Client must be notified to DRIVINE in writing as soon as possible.

In case of cancellation:

  • More than 48 hours before the start of the Service, no fees will be charged to the Client;

  • Between 24 and 48 hours before the start of the Service, 50% of the fees will be charged;

  • Less than 24 hours before the start of the Service or in case of non-presentation of the Client, 100% of the fees will be charged.

DRIVINE reserves the right to cancel any reservation confirmed by the Client in the following cases: force majeure, non-payment of overdue invoices, incorrect or dangerous behavior of the Client or the Passengers, request not compliant with the CGV, etc.

 

5. INSURANCE

 

DRIVINE has professional liability insurance covering bodily and material damage caused to third parties as a result of the passenger transport activity.

Each vehicle made available by DRIVINE is insured for passenger transport within the framework of the VTC activity.

 

6. COMPLAINTS

 

Any complaint must be made in writing and sent to DRIVINE as soon as possible and no later than eight (8) days following the date of the Service.

 

7. PERSONAL DATA

 

The processing of personal data by DRIVINE complies with the legislation in force on the protection of personal data. For more information on the collection and processing of your personal data, please refer to our privacy policy accessible on our website.

 

8. APPLICABLE LAW AND JURISDICTION

 

These CGV are subject to French law. Any dispute relating to their interpretation, execution, or termination falls under the exclusive jurisdiction of the French courts.
